LEADNAV Terms of Use

Effective Date: August 24 2025

These Terms of Use (“TOU”) are a legal agreement between you and LEADNAV Systems LLC (“LEADNAV,” “we,” “our,” or “us”) governing your access to and use of:

Our websites, including leadnavgps.com, leadnavsupply.com, and related domains;
The LEADNAV GPS mobile application (“App”);
Any maps, files, services, and features offered by LEADNAV;
Any related products, software, updates, and support services (collectively, the “Service”).

By accessing or using the Service, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, you may not use the Service.

1. Privacy Policy

Your use of the Service is also governed by the LEADNAV Privacy Policy, which describes how we collect, use, and protect your information.

2. Third-Party Maps and Services

The LEADNAV App integrates third-party maps and imagery (including satellite, topo, and terrain). These services are provided by outside companies that we license.

We cannot guarantee the availability or accuracy of third-party maps.
Providers may add, change, or discontinue services at any time.
LEADNAV may remove or replace map sources at our discretion.
Subscriptions to LEADNAV features do not guarantee permanent access to any specific third-party map layer.

3. GPS Files and User Data

Unlike some other platforms, LEADNAV does not collect, sell, or trade user GPS files.

Any maps, tracks, routes, or GPS files you create remain your property.
Files are stored locally on your device unless you choose to share them.
We respect your privacy and do not access or use your data without your consent.

4. Group Tracking and Location Data

If you enable Group Tracking, your location is transmitted and temporarily stored on Amazon Web Services (AWS)servers to share with contacts you select.

Location data is only shared with people you explicitly authorize.
LEADNAV does not monitor, sell, or exploit this data.
AWS stores/processes data solely to provide hosting services under strict compliance standards.
By using Group Tracking, you acknowledge that your data will be transmitted and stored by AWS solely for the functionality of this feature.

5. App Purchases and Subscriptions

All purchases of the LEADNAV GPS App and subscriptions are processed through Apple’s App Store or Google Play.
LEADNAV does not directly process or refund in-app payments.
Refunds and cancellations must be managed through the applicable App Store.

6. Hardware Purchases

Custom hardware products (cases, mounts, antenna packages, etc.) are sold exclusively through our Shopify store at leadnavsupply.com.

All hardware sales are final once production begins.
Customers are responsible for ordering the correct device model.
Refunds, restocking, and shipping terms are governed by our Shopify store policies.

7. User Responsibilities

You agree not to misuse the Service. You may not:

Upload or transmit unlawful, harmful, or abusive content;
Interfere with or attempt to disrupt servers or networks;
Reverse-engineer, copy, or resell the App or its data;
Use the Service to infringe on property rights or laws;
Rely on the Service as a legal survey or substitute for official navigation data.

The Service is designed as a navigation aid only. Always verify boundaries, conditions, and safety information independently.

8. Safety Disclaimer

Off-road navigation, motorsports, and field operations involve inherent risks, including accidents, injury, death, or property damage.

You assume all responsibility and risks associated with using the Service.
LEADNAV Systems LLC is not liable for damages, losses, or injuries resulting from use of the App, hardware, or maps.

9. Intellectual Property

LEADNAV retains ownership of the App, websites, and Services, including all intellectual property rights.
You may not copy, modify, or distribute our software, maps, or materials except as explicitly authorized.
All trademarks, logos, and service names displayed are the property of LEADNAV or their respective owners.

10. Modifications and Updates

LEADNAV may update or discontinue features of the Service at any time without notice, including adding or removing third-party map layers or services.

11. Indemnification

You agree to indemnify and hold harmless LEADNAV, its affiliates, officers, employees, and contractors from any claims, damages, or expenses (including legal fees) arising out of your use of the Service or violation of these Terms.

12. Limitation of Liability

To the fullest extent permitted by law:

LEADNAV shall not be liable for indirect, incidental, special, or consequential damages, including lost profits, lost data, or equipment damage.
LEADNAV’s total liability for any claim will not exceed the greater of $50 USD or the amount you paid for the Service in the 12 months prior to the claim.

13. Termination

We may suspend or terminate your access to the Service if you violate these Terms. Upon termination, your right to use the Service will immediately cease.

14. Governing Law

These Terms are governed by the laws of the State of North Carolina, USA, without regard to conflict of law principles.

15. Arbitration and Waiver of Class Actions

By using the Service, you agree that:

Any disputes will be resolved through binding arbitration in North Carolina under the rules of the American Arbitration Association (AAA).
Claims must be brought on an individual basis. Class actions, consolidated claims, or representative proceedings are not permitted.
